Please read this form and be aware that, in signing up and participating in NITLEX Entertainment Inc. or Rentals, you will be waiving and releasing all claims for injuries arising out of these or any activities, rentals or equipment, that you, guests, attendees, visitor, observer, spectators and participants / non-participants might sustain. The terms “I”, “me”, and “my”, also refer to parents or guardians as well as participants in these activities. In signing for these activities, you are agreeing as follows:

As the parent or guardian of the participant in NITLEX Entertainment Inc. Mobile Nerf Wars and rental equipment, I recognize and acknowledge that there are certain risks of physical or health injuries, and I agree to assume the full risk of any injuries, damages, loss, exposures and or including death. As a result, that I may sustain in participating, in any manner, in any and all activities connected with or associated with such activities. I further recognize and acknowledge that all athletic activities involving strenuous exertion or potential body contact are hazardous recreational activities and involve substantial risk of injury.

I agree to waive and relinquish any and all claims I may have as a result of renting or participating in these activities against NITLEX Entertainment Inc., any and all other participating servants and employees of the governmental bodies and independent contractors, staff, employees, and all other persons and entities, of whatever nature, that might be directly or indirectly liable for any injuries that I may sustain while participating in these activities. (The parties described in the preceding sentence are referred to as “release parties” in the remainder of this agreement)

I do hereby fully release and discharge NITLEX Entertainment Inc. and the other released parties from any and all claims for injuries, damage, loss, health risk exposure and or including death that I may have or that can accrue to me on account of my participation in these activities.

I further agree to indemnify, hold harmless and defend NITLEX Entertainment Inc. and any and all other released parties, from any or all claims resulting from injuries, damage, loss, health risk exposure and or including death sustained by anyone, including me or my child, attendees, participants, and arising of, connected with, or any way associated with my conduct and the activities of these programs.

I further understand and agree that the terms such as “participation”, “programs”, and “activities”, referred to in this agreement include all exercises and physical movements of any nature while I am participating in these programs and further included the provision of or failure to provide proper instruction or supervision, the use and adjustment of any and all machinery, equipment, and apparatus, and anything related to my use of the services or premises involved in these activities, and transportation to from any events.

PARENTAL CONSENT (REQUIERED FOR PARTICIPANTS UNDER THE AGE OF 18) AND I, the minor’s parent and/or legal guardian, or responsible party, understand the nature of the above referenced activities and the minor’s experience and capabilities and believe the minor to be qualified to participate in such activity. I hereby release, discharge, covenant not to sue and AGREE TO INDEMNIFY AND SAVE AND HOLD HARMLESS each of the releases from all liability, claims, demands, losses, and or damages on the minor’s account caused or alleged to have been caused in whole or in part by the negligence of the releases or otherwise, including negligent recuse operations, and further agree that if, despite this release, I, the minor, or anyone on the minor’s behalf makes a claim against any of the above releases, I WILL INDEMNIFY, SAVE AND HOLD HARMLESS each of the releases from any litigation expenses, mediation, attorney fees, loss liability, damage, or cost any release may incur as the result of any such claim.

I understand it is the parent’s/legal guardian’s responsibility to warn the child(ren)/self about injury risks, and I will encourage my child(ren) to follow all directions given by staff members, officers, directors, agents, shareholders, employees, contractors and volunteers.

I hereby relieve NITLEX Entertainment Inc. from responsibility and agree to provide for all medical expenses which may be incurred by me or any of my children, as a result of any injury sustained while participating in any activity at or for (regardless of location).

I fully understand that staff members are not first responders, physicians or medical practitioners of any kind. I hereby release NITLEX Entertainment Inc., staff to render first aid to my child(ren)/self, in the event of any injury or illness. If deemed necessary NITLEX Entertainment Inc. will in best effort will assist in seeking professional medical help by calling a emergency services for said child(ren)/participant. I also affirm that I now have and will continue to provide proper hospitalization, health and accident insurance coverage, which I consider adequate for my child(ren)/self-protection.

NITLEX Entertainment Inc. are not responsible for any damage to any vehicle, structure or any personal property while on the premise.
